Question about new EULA

I noticed there was an announcement about changes to the EULA in April, and I started wondering about it.



I have to state before I say anything else, I am not interested challenging the EULA to create any trouble, or arguing about it so others can cause trouble, I am genuinely interested in the implications.



Ok, so to the point - I saw the notice, and I booted up the game for the first time in a few weeks, just to see what would happen. There was no pop-up making me agree to the new EULA, so my question is, is it legally enforceable?



I don't mean the kind of enforcement where TWI can come along and take away my cd-key, just because they can! ... but the kind that would stand up to a challenge in court, if it came to it, if you did not have any record of me agreeing to the new terms.



I believe, and I may be wrong, that I had to agree to a EULA when installing the game, and in court, this would be the EULA I would be held to, if I was to cause any trouble and have it revoked. If it was possible for a company to come along after that and just change a EULA without agreement, then surely it would be open to abuse, such as for example, adding a rule that states 'You agree to pay TWI $1000 every time you join a server for RO2'.



Anyway, I may totally be missing something here, as there may be a clause in the EULA somewhere that states TWI can in fact change the rules without our consent and we are bound to that, or maybe the new EULA changes concern the server owner's version, which may indeed have to be clicked for agreement now, or something else my quasi-legal brain has overlooked! I did try searching fora copy of the complete EULA in my steam folders and here on this forum, but I couldn't find it.



Like I say, my intention is not to open the gates to any trouble concerning the replies to this thread, so if someone would like to reply, but not publicly, feel free to do it in a PM to me, and I promise, if you also want me to, to keep the information you send private and keep it between the two of us.
